PERFORMANCE ROYALTIES TARIFF

It couldn’t be easier to produce a VailPlay. This pricing tariff is designed to help you work out easily how much it will cost (in terms of script charges and amateur royalty fees) to produce a play by Alexander Vail. Different scripts have different prices, so this tariff is divided into the following categories:

  • Full-length stageplays
  • One-act stageplays (including Fringe Festival productions)
  • Plays for schools and colleges
  • Pantomimes (full­‐length)
  • Short- or Micro-plays

Full-length stageplays
Scripts: the Playwright can provide either:
1) a printable PDF version of the Play (£43.00), or
2) printed, bound copies of the Play (£6.00 each), as per the Producer’s requirements

Royalties for amateur performance are based on the number of seats in your auditorium, regardless of how many seats are actually sold for each performance.

  • 1­‐50 seats: £30.00 per performance
  • 51­‐100 seats: £42.00 per performance
  • 101­‐150 seats: £54.00 per performance
  • 151­‐250 seats: £67.00 per performance
  • 251­‐500 seats: £82.00 per performance
  • Over 501 seats: price on application

One-act stageplays
Scripts: the Playwright can provide either:
1) a printable PDF version of the Play (£27.00), or
2) printed, bound copies of the Play (£4.00 each), as per the Producer’s requirements

Royalties for amateur performance are based on the number of seats in your auditorium, regardless of how many seats are actually sold for each performance.

  • 1­‐50 seats: £19.00 per performance
  • 51­‐100 seats: £25.00 per performance
  • 101­‐150 seats: £31.00 per performance
  • 151­‐250 seats: £38.00 per performance
  • 251­‐500 seats: £45.00 per performance
  • Over 501 seats: price on application

Fringe theatre productions of One­‐act stage plays (as part of a recognised Fringe Festival):

  • Scripts: the Playwright can provide a printable PDF version of the Play (£24.00)
  • Royalties for Fringe performance are:
    1­‐250 seats: £20.00 per performance / Over 251 seats: £30.00 per performance

Plays for Schools & Colleges

  • Scripts: the Playwright can provide a printable PDF version of the Play (£43.00)
  • Royalties for school or college performance are:
    1­‐250 seats: £32.00 per performance
    Over 251 seats: £44.00 per performance

Pantomimes (full-length)
Scripts: the Playwright can provide a printable PDF version of the Play (£43.00)

  • Scripts: the Playwright can provide a printable PDF version of the Play (£25.00), which then may be performed royalty-free.

PERFORMANCE RIGHTS

Please read the terms and conditions below before completing this Performance Rights Application.

TERMS & CONDITIONS

In these Terms and Conditions, “the Playwright” refers to Alexander Vail; “the Play” refers to any written work (including full-length, one-act, short- or micro- stage plays, novels, stories, monologues, musicals, operettas, treatments, screenplays, radio plays or any other script) created by the Playwright; “the Producer” refers to the person, theatre, school, company or other entity purchasing rights to perform a Play by the Playwright.

Alterations
The Producer shall not alter the text or title of the Play, nor permit others so to alter the Play without the Playwright’s written permission. Any alterations agreed by the Playwright shall belong to the Playwright absolutely and no payment shall be due to any person making the alterations without a prior collaboration agreement.

Casting
The Producer retains discretion in casting, as well as choices of director, designer and actors. However, if the Playwright disagrees with such castings and appointments, or feels they will misrepresent the Play, He reserves the right to withdraw Performance Rights and agrees to refund all Royalties received.

Performance rights agreement
The Producer may not perform any Play by the Playwright in full or part without returning a signed Performance rights agreement. This should be returned no later than two months prior to the first performance, with payment made in full no later than 30 calendar days prior to the first performance.

Performance date amendments
On returning a signed Performance rights agreement, the Producer commits to a specific number of performances of the Play. The number of performances may be extended, commuted or altered no later than 7 days prior to the first performance. In such a situation, the Producer is required to notify the Playwright in writing, and will be send a Performance right amendment for the new performance dates.

Refunds
If the Producer notifies the Playwright of cancellations of any performances no later than 7 days prior to the first performance, a refund will be made available for up to 3 cancelled performances, but not for any further cancelled performances.
Please note that amendments notified later than 7 days prior to the first performance are not eligible for refund.

Please note that no refunds will be made for scripts purchased (either paper or digital copies).

Publicity
The Playwright shall provide a biography for use in publicity by a date agreed. The Playwright shall co-operate with the Producer in publicising the Play.
The Playwright shall be sent draft copies of all programmes and publicity material relating to the Play in advance of going to print, and will have 24 hours to approve.
The Playwright will endeavour to attend publicity interviews subject to prior professional commitments.
The Producer will provide one free seat for the Playwright and two for his Guests for the first full performance of the Play and if applicable the press night. The Playwright may attend any performance free of charge with seating subject to availability. The Producer may request the Playwright to attend pre- or post-show discussions. Appearance fees and/or travel expenses may apply depending on location / timings / frequency etc.

Copyright
The Copyright of the Play shall remain vested in the Playwright and no rights shall be granted to the Producer.

Incidental / Interpolated Music
The Producer shall be responsible for clearing at his/her own expense the rights to any incidental music used in the production of the Play. Any songs or music mentioned by name in the Play are the suggestions of the Playwright and do not imply that performance rights for them have been sought or granted. Any changes made to the suggested music featured in the Play are subject to approval from the Playwright.

Where the Playwright requires the use of specific music as interpolated music the Producer shall be responsible for clearing the rights for the use of such music. If the rights are not available the Producer, after consultation with the Playwright, shall have the right to change the music specified by the Playwright. The Producer shall have the right to refuse to use music where the additional cost exceeds his/her budget. If the Playwright insists on the use of the music the Producer shall recoup the cost from the Playwright.

Writer’s credit
The Producer agrees to credit the Playwright on all publicity including posters and programmes. Where either the director and/or the leading actors are also credited the Playwright’s credit shall be of equal size and degree of boldness in type and prominence.Vailplays Performance Royalty Agreement

Jurisdiction
This contract shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction, unless otherwise mutually agreed.
